1. Agreement to Terms

By accessing or using ElectrIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

ElectrIQ provides information, tools, and recommendations related to electric vehicles in Canada, including:

• AI-powered vehicle recommendations and advice
• Rebate calculators and eligibility information
• Educational content about electric vehicles
• Financing and insurance lead generation services
• Affiliate product recommendations

3. Intellectual Property Rights

3.1 Our Intellectual Property

All content, features, and functionality of the Service, including but not limited to software code and algorithms, text, graphics, logos, database schemas, AI-generated responses, rebate calculations, and user interface designs are owned by ElectrIQ and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

3.2 Trademarks

ElectrIQ™ and all related logos, product and service names, designs, and slogans are trademarks of ElectrIQ. You may not use these marks without our prior written permission.

3.3 Limited License

Subject to these Terms, ElectrIQ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use only.

4. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service
• Use automated systems (bots, scrapers, crawlers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Frame or mirror any part of the Service without written permission

4.2 Data Restrictions

• Extract, scrape, or harvest data from the Service's databases
• Copy, reproduce, or republish our rebate data or calculations
• Use our data to create competing products or services
• Access the Service to build a similar or competitive service

4.3 Security Restrictions

• Attempt to gain unauthorized access to any portion of the Service
• Probe, scan, or test the vulnerability of the Service
• Breach or circumvent any security or authentication measures
• Interfere with or disrupt the Service or servers

5. Affiliate Disclosures

5.1 Affiliate Relationships

ElectrIQ participates in affiliate marketing programs. We may receive commissions when you click on certain links or purchase products through our recommendations. These relationships do not affect the objectivity of our recommendations.

5.2 Independence

Our editorial content and AI recommendations are independent of our commercial relationships. We only recommend products and services we believe provide value to Canadian EV buyers.

6. Lead Generation Services

6.1 Lead Submission

When you request information about insurance or financing through our Service, your information will be shared with qualified partner companies who may contact you. You may opt out of future communications at any time.

6.2 No Guarantee

We do not guarantee approval for financing or insurance products, specific rates or terms, or the quality of partner services.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. While we strive for accuracy, we do not warrant that rebate information is current, calculations are error-free, or AI recommendations are optimal for your situation.

You are responsible for verifying all rebate eligibility requirements with government sources and confirming vehicle specifications with manufacturers before making decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTRIQ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, OR DATA.

Our total liability for any claims shall not exceed the greater of (a) CAD $100 or (b) the amount you paid us in the 12 months before the claim arose.

9. Indemnification

You agree to indemnify, defend, and hold harmless ElectrIQ and its officers, directors, employees, and agents from any claims, losses, damages, or expenses arising from your use or misuse of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with PIPEDA and applicable provincial privacy laws.

11. Modifications to Terms

We may modify these Terms at any time. We will update the "Last Updated" date and material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.

12. Termination

We may terminate or suspend your access immediately, without prior notice, if you breach these Terms, engage in prohibited uses, or we suspect fraudulent or illegal activity.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.

14. Dispute Resolution

Before filing a claim, you agree to contact us at legal@electriq.ca to attempt informal resolution. If informal resolution fails, either party may elect binding arbitration under the Arbitration Act (Ontario).

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Notice to Users in Quebec

For users in Quebec, these Terms are subject to Quebec's Consumer Protection Act where applicable. You have the right to resolve disputes through Quebec's consumer protection office, and certain limitations of liability may not apply under Quebec law.
